Book VI of the French Commercial Code applies uniformly. Differences arise from special regimes applicable to certain activities (agriculture, regulated professions, financial institutions, carriers, operators of classified installations) and from the administrative authorisations that must be preserved during the proceedings.
The timetable is adapted to the operating cycle: opening a mandat ad hoc or conciliation before the low season allows deadlines to be negotiated with creditors without publicity, whereas the observation period of formal insolvency proceedings should cover a full cycle to be meaningful.
Each company in the network keeps its own legal personality and is subject to separate proceedings; French law nonetheless allows related entities to be coordinated through group proceedings rules and cooperation between courts.
